§ 258-nn. New York delegation; limitation on voting. The New York\ndelegation to the northeast interstate dairy compact commission, or any\nmember thereof, shall not vote to include all or part of New York state\nas part of a regulated area, as that term is defined in subdivision (e)\nof section two of article two of the northeast interstate dairy compact\nset forth in section two hundred fifty-eight-kk of this article, if the\ncompact over-order price regulation or commission marketing order for\nsuch regulated area would establish a price for class I milk in all or\npart of New York state which is in excess of the highest price for class\nI milk in the New York-New Jersey marketing area at any time up to the\neffective date of this section, as calculated by the market\nadministrator in the New York-New Jersey milk marketing area, adjusted\nannually by the rate of change in the consumer price index as reported\nby the bureau of labor statistics of the United States department of\nlabor.\n
