* § 892. Town of Brookhaven industrial development agency. 1. For the\nbenefit of the town of Brookhaven, county of Suffolk, and the\ninhabitants thereof, an industrial development agency, to be known as\nthe town of Brookhaven industrial development agency, is hereby\nestablished for the accomplishment of any or all of the purposes\nspecified in title one of article eighteen-A of this chapter. It shall\nconstitute a body corporate and politic, and be perpetual in duration.\nIt shall have the powers and duties now or hereafter conferred by title\none of article eighteen-A of this chapter upon industrial development\nagencies and provide that the exercise of the powers by such agency with\nrespect to the acquisition of real property whether by purchase,\ncondemnation or otherwise shall be limited to the corporate limits of\nthe town of Brookhaven, and such agency shall abide by the local zoning\nordinances and planning regulations and shall take into consideration\nthe regional and local comprehensive land use plans. It shall be\norganized in a manner prescribed by and be subject to the provisions of\ntitle one of article eighteen-A of this chapter. Its members shall be\nappointed by the governing body of the town of Brookhaven, county of\nSuffolk. The agency, its members, officers and employees, and its\noperations and activities shall in all respects be governed by the\nprovisions of title one of article eighteen-A of this chapter. To the\nextent that the foregoing provisions of this subdivision or of title one\nof this article are inconsistent with the provisions of subdivision two\nof this section, the provisions of such subdivision two shall be\ncontrolling.\n 2. The provisions of subparagraph two of paragraph (b) of subdivision\none of section eight hundred fifty-six of this article shall not apply\nto the town of Brookhaven industrial development agency and the agency\nas created and constituted pursuant to the other provisions of this\narticle is continued until otherwise altered or terminated pursuant to\nlaw.\n * NB Agency expires per §§ 856 and 882\n * NB There are 2 § 892's\n
