* § 895-i. Steuben county industrial development agency. 1. For the\nbenefit of the county of Steuben and the inhabitants thereof, an\nindustrial development agency, to be known as the STEUBEN COUNTY\nINDUSTRIAL DEVELOPMENT AGENCY, is hereby established for the\naccomplishment of any or all of the purposes specified in title one of\narticle eighteen-A of this chapter. It shall constitute a body corporate\nand politic, and be perpetual in duration. It shall have the powers and\nduties now or hereafter conferred by title one of article eighteen-A of\nthis chapter upon industrial development agencies and provided that the\nexercise of the powers by such agency with respect to the acquisition of\nreal property whether by purchase, condemnation or otherwise, shall be\nlimited to the county of Steuben, and such agency shall take into\nconsideration the zoning and planning regulations as well as the\nregional and local comprehensive land use plans. It shall be organized\nin a manner prescribed by and be subject to the provisions of title one\nof article eighteen-A of this chapter. Its members shall be appointed by\nthe governing body of the county of Steuben. The agency, its members,\nofficers and employees and its operations and activities shall, except\nas provided specifically herein, be governed by the provisions of title\none of article eighteen-A of this chapter.\n 2. In addition to the powers and duties now or hereafter conferred by\ntitle one of article eighteen-A of this chapter, the agency shall have\nthe power (i) to acquire, construct, own, maintain, and lease or sell to\na railroad or private business corporation any interest in railroads\noperated within Steuben county, including easements or rights of way,\nnecessary switching apparatus, track, and other equipment necessary or\nconvenient to the operation of such railroad, which will be used in\nconjunction with industrial, manufacturing, commercial, recreational or\nwarehousing operations and (ii) to finance such facilities through the\nissuance of its bonds and notes, when in the judgment of the agency,\nsuch facilities will serve to promote, develop, encourage and assist in\nthe acquiring, constructing, reconstructing, improving, maintaining,\nequipping and furnishing of industrial, manufacturing, warehousing,\ncommercial, recreational and research facilities including industrial\npollution control facilities and thereby advance the job opportunities,\nhealth, general prosperity and economic welfare of the people of the\nstate and improve their prosperity and standard of living.\n * NB Agency expires per §§ 856 and 882\n
