N.Y. STF Law § 99-JJ

§ 99-jj. New York state drug treatment and public education fund. 1.\nThere is hereby established in the joint custody of the state\ncomptroller and the commissioner of taxation and finance a special fund\nto be known as the "New York state drug treatment public education\nfund".\n 2. Such fund shall consist of revenues received pursuant to the\nprovisions of section ninety-nine-ii of this article and all other\nmoneys credited or transferred thereto from any other fund or source\npursuant to law. Nothing contained in this section shall prevent the\nstate from receiving grants, gifts or bequests for the purposes of the\nfund as defined in this section and depositing them into the fund\naccording to law.\n 3. The moneys in such fund shall be expended to the commissioner of\nthe office of addiction services and supports and disbursed, in\nconsultation with the commissioner of the department of health, the\noffice of mental health, the office of cannabis management and the\ncommissioner of education for the following purposes:\n (a) Reasonable costs incurred, subject to available appropriations, by\nthe office of addiction services and supports, to administer funds in\naccordance with the allowable uses in paragraphs (b), (c), (d) and (e)\nof this subdivision.\n (b) To develop and implement a youth-focused public health education\nand prevention campaign, including school-based prevention, early\nintervention, and health care services and programs to reduce the risk\nof cannabis and other substance use by school-aged children;\n (c) To develop and implement a statewide public health campaign\nfocused on the health effects of cannabis and legal use, including an\nongoing education and prevention campaign that educates the general\npublic, including parents, consumers and retailers, on the legal use of\ncannabis, the importance of preventing youth access, the importance of\nsafe storage and preventing secondhand cannabis smoke exposure,\ninformation for pregnant or breastfeeding women, and the overconsumption\nof edible cannabis products;\n (d) To provide substance use disorder treatment programs for youth and\nadults, with an emphasis on programs that are culturally and gender\ncompetent, trauma-informed, evidence-based and provide a continuum of\ncare that includes screening and assessment (substance use disorder as\nwell as mental health), early intervention, active treatment, family\ninvolvement, case management, overdose prevention, prevention of\ncommunicable diseases related to substance use, relapse management for\nsubstance use and other co-occurring behavioral health disorders,\nvocational services, literacy services, parenting classes, family\ntherapy and counseling services, medication-assisted treatments,\npsychiatric medication and psychotherapy; and\n (e) To evaluate the programs being funded to determine their\neffectiveness.\n 4. On or before the first day of February each year, the commissioner\nof the office of addiction services and supports shall provide a written\nreport to the temporary president of the senate, speaker of the\nassembly, chair of the senate finance committee, chair of the assembly\nways and means committee, chair of the senate committee on alcoholism\nand drug abuse, chair of the assembly alcoholism and drug abuse\ncommittee, the state comptroller and the public. Such report shall\ndetail how the moneys of the fund were utilized during the preceding\ncalendar year, and shall include:\n (a) the amount of money dispersed from the fund and the award process\nused for such disbursements;\n (b) recipients of awards from the fund;\n (c) the amount awarded to each recipient of an award from the fund;\n (d) the purposes for which such awards were granted; and\n (e) a summary financial plan for such monies which shall include\nestimates of all receipts and all disbursements for the current and\nsucceeding fiscal years, along with the actual results from the prior\nfiscal year.\n 5

Moneys shall be payable from the fund on the audit and warrant of\nthe comptroller on vouchers approved and certified by the commissioner\nof addiction services and supports.\n
