§ 40. Powers and duties of fence viewers. The assessors shall perform\nall the duties and shall exercise all the powers hereinafter imposed and\nconferred upon fence viewers. In a town having a sole appointed\nassessor, the assessor and the members of the town board shall act as\nfence viewers.\n
