4.1-26-27. Assessments - Continuing appropriation

1. a. Each licensed processor shall pay to the milk marketing board an amount

determined by the board but not exceeding eighteen cents per hundredweight

[45.36 kilograms], on all milk and milk equivalents used by the processor in

manufacturing milk products and frozen dairy products.

b. The assessment required in accordance with this section is not imposed on milk

products or frozen dairy products sold outside this state.

2. The assessment required by this section must be calculated quarterly and paid within

fourteen days after the end of each calendar quarter.

3. The board shall forward all moneys received under this chapter to the state treasurer

for deposit in the milk marketing fund. All moneys in the milk marketing fund are

appropriated on a continuing basis to the board to carry out this chapter.
