4.1-40.1-11. Adulteration of a beneficial substance prohibited
A person may not distribute an adulterated beneficial substance. A beneficial substance is
deemed to be adulterated if the beneficial substance:
1. Contains any deleterious or harmful substance in sufficient amount to render it
injurious to beneficial plant life, animals, humans, aquatic life, soil, or water when
applied in accordance with directions for use on the label;
2. Does not provide on the label of the substance adequate warning statements and
directions for use, which may be necessary to protect plant life, animals, humans,
aquatic life, soil, or water;
3. Composition falls below or differs from that which it is purported to possess by its label
or any labeling which describes the composition of the beneficial substance; or
4. Contains unwanted crop or weed seed, or primary noxious or secondary noxious weed
seed.
