4.1-53-35. Tree seed and shrub seed - Label requirements - Percentage of
germination.
1. If the tree seed or shrub seed belongs to a species for which standard germination
testing procedures are prescribed by the association of official seed analysts, the label
must include:
a. (1) The percentage of germination, exclusive of hard seed;
(2) The percentage of hard seed; and
(3) The month and year in which the percentage of germination was
determined; or
b. A statement indicating that the test to determine the percentage of germination is
not yet completed and that the results will be supplied upon request.
2. If the tree seed or shrub seed belongs to a species for which standard germination
testing procedures are not prescribed, the label must include the year in which the
seed was collected.
