The Department shall adopt and promulgate all necessary rules
and regulations including rules and regulations for hearings and
appeals, subject to the provisions of this act and the
Administrative Procedures Act, for the implementation of this act.
Provided, the Department shall coordinate its regulations with the
Office of Surface Mining to ensure consistency in regulatory actions
and that state interpretations of the law and regulations are not
more restrictive than those of the Office of Surface Mining.
