Federal approval – Promulgation of rules

A. 1. The Oklahoma Health Care Authority shall seek any

federal approval necessary to implement the Ensuring Access to

Medicaid Act. This shall include, but not be limited to, submission

to the Centers for Medicare and Medicaid Services of any appropriate

demonstration waiver application or Medicaid State Plan amendment

necessary to accomplish the requirements of this act within the

required time frames.

2. Prior to implementation of contracts with any contracted

entities except dental benefit managers, the Authority shall obtain

federal approval of a managed care directed payment program with an

average commercial rate methodology under the Supplemental Hospital

Offset Payment Program Act. Contracts with dental benefit managers

shall be exempt from the requirement stipulated by this paragraph.

B. The Oklahoma Health Care Authority Board shall promulgate

rules to implement the Ensuring Access to Medicaid Act.
