Distributions from Private Prison and Halfway House

Capacity Development Revolving Fund.

A. The Department of Corrections shall not make any

distributions from the Private Prison and Halfway House Capacity

Development Revolving Fund except as required by this section.

B. The Department of Corrections may utilize the monies in the

Private Prison and Halfway House Capacity Development Revolving Fund

in order to make payments pursuant to contracts for private prison

space and halfway houses at facilities located within the state as

such contracts were in effect on July 1, 2007, for the purpose of

funding up to a five-percent increase in payments to be made

pursuant to such contracts.
