Change of insurance carriers

A. In any case where an employer changes insurance carriers or

where the employer having been self-insured, becomes insured or,

having been insured, is approved to be self-insured, and the only

dispute in a claim against that employer is the proper source of

payment of benefits, the Commission shall direct that the

appropriate compensation benefits be paid on an equal basis by the

carriers or self-insured employer.

B. Upon resolution of the issue, the prevailing respondent

shall be entitled to reimbursement from the other respondent of all

monies paid together with interest from the date of payment pursuant

to Section 727.1 of Title 12 of the Oklahoma Statutes.
