Divorce/House situation - MA

divorce attorney Massachusetts Aug 22, 2026
Hi all, So my wife of 20 years is divorcing me. Location: Massachusetts She went to the courthouse and got the forms for a 1A divorce (uncontested). She says I can take anything I want from the house, but to leave her the house. However the house is the only significant asset we own. We have 2 kids 17 and 19. I am not on the mortgage/deed, the house was bought 10 years ago while we were married and what I have been told is this is an equitable distribution state. House was bought in 2016 for 215k, there is 185k left on the mortgage, the property is valued at 400k. I work but have no savings, I live paycheck to paycheck. I make too much to qualify for legal assistance, and I am very disabled physically. I have not and will not sign anything of course. My problem is, I have nowhere to go, neither does she. We both occupy the home currently. I don't feel I can let her keep the house with me having to live in my car, that is not fair. I contributed to the bills and furniture and stuff over the years, it does me no good to take whatever I want from the house with nowhere to put it. I don't know how I can get a lawyer when I don't qualify for assistance or legal aid.
