Help with understanding emergency custody

Location: Virginia and New York My 16-year-old niece lives in New York with her mother. My sister has been investigated by CPS 4 times in the past for her treatment of my niece. My niece is currently visiting me in Virginia. My niece has told me about abuse and medical neglect including giving her medication that's not prescribed to her and is very dangerous and has given her weed. She also constantly refuses to address or doesn't care to address her disability/medical needs. My niece wants to live with me permanently. I want to know whether I can obtain custody or guardianship and whether Virginia has emergency jurisdiction.
