Employer may be violating FLSA
employment attorney Ohio Oct 26, 2026
Location: Ohio This is an alt account. I work for a company that does contracted work. We get contracts to provide one of two services from X date to Y date, and during those days from A hour to B hour. As such, all our employees are scheduled during those service hours, and are not supposed to work beyond those hours. With that said, people still come in 5-15 minutes early often enough, and of course even beyond that almost nobody ever really clocks in or out directly at their scheduled times. I had asked about a rounding policy to see how payroll is done, as would conform with the FLSA. The issue is that I was told that employees doing service 1 are just rounded to the scheduled shifts (note, they're not rounded to specific hour marks, but instead just to the schedule) unless they have to stay late for a very specific reason, and employees doing service 2 are payed on the exact clock in and clock out times. The reason I was given is because service 1 doesn't usually require they stay late or do anything extra, while service 2 often results in them working outside of the contracted service hours and having to take on extra tasks. Practically speaking, I get what they're going for, but it feels illegal. When I voiced my concerns, I was told they confirmed with their attorney that it's legal due to being contracted work for clients. No part of that sounds right, and I genuinely think their attorney is failing them. Does anyone have any thoughts, or any suggestions on what could be done?
