Location: California Assisting a senior family member with a fight they’re having with what is essentially an HOA/landlord hybrid non-profit My relative had a visitor that’s banned from the area they live in. The bylaws of the HOA lay out both the process for any sort of formal notification (USPS mail to last known address) and the procedure for punitive fines (first notice is a warning, followed by additional notices to include fines). Their Board levied fines after a verbal notification at a membership meeting that never had a follow-up formal written notice. They (the board) have since fined my relative additional times for the same violation when the circumstances were beyond their control (break-ins and the like). The fines are currently $1000 (for the record, the first fine is supposed to start at $25 and they started at $500) and my family member has refused to pay them. Now the HOA board is attempting to expel them for nonpayment (which would lead to an eviction). I’m trying to assist my family member fight the fines and this proposed expulsion but don’t know what their best avenue is. Small claims court? Something involving breach of contract? The HOA board is unsympathetic and are known for shady behavior. Could they recoup the cost of obtaining a mediator from the HOA if it came to that?

Location: Escondido, California. (North County San Diego) Complex is 8 units with a board of 2 members. Half of the units are rented out. HOA is in the red and missing payments on landscaping, roof repair, water, and mostly recently the master insurance policy (Which lapsed last month). Management company hasn’t been paid and stated the HOA has no reserves left. I expect them to drop us soon. We’re not able to meet quorum multiple months in a row as one of our directors and the other owners just doesn’t seem to want to vote. The vote is for a desperately needed special assessment to rebuild our degrading roof, pay our debts, and get a new sb326 inspection. I was asked to join the board by the management company, but I don’t want all that liability until things are fixed. But I really don’t see how that’s possible when no one is getting involved with the meetings. At this point I can only see that a receiver is the only way to get things done, but other than the sheer cost of that..I only see the main issue of lack of involvement to continue even after a receiver. I rather not be stuck in the same situation again. Also it’s been a week since I asked for documents from management company so I can file a receiver, but their silence is concerning. Location: California One of our neighbors has several cars and RV’s parked along the road actually on our property. We can technically still get through with a small vehicle, but all the pullouts and shoulder is blocked. These have been there for several years and are full of rats and trash. We have asked him to move them but he is a bit loony and has all these excuses for why they can’t move or be gotten rid of. Yesterday there was a fire at the bottom of the hill, where that road goes. The fire department got to his property and turned around and left. (They had to access the fire from another road, on the other side of the canyon. It is out now.) But this brings back up the issue of the road being blocked. Pg&e can’t get their tree crews down there to maintain the fuel break in their easement, and the fire department can’t get through which puts several homes in immediate danger. I want to just report them abandoned and have them towed, but there is concern that this is not legal. Is there a better way to go about having these vehicles removed? What can we do?
