In January 2009, I had the distinct opportunity to argue an issue of first impression to the 5th District Court of Appeal regarding sealing and/or expunging criminal and civil arrest records. After my arguments in Kanji v. State, 4 So.3d 65 (5th DCA 2009), the 5th District Court of Appeal ruled that although a Judge has "sole discretion" to deny the sealing or expunging a criminal record, it is not unfettered discretion and he or she may not arbitrarily deny a sealing or expunction. While exercising his or her discretion, the Judge must consider all the facts and circumstances and may not deny the petition based solely on the nature of the crime.. In 1983, immediately after having graduated Oak Ridge High School I passed the state examination and procured a Florida salesman's real estate license. Early in 1986 I became licensed in Florida as a real estate broker. The following year I graduated the University of Florida with a B.S.B.A. with a major concentration in Real Estate and Urban Analysis. After graduating from UF I became employed by Easley, McCaleb and Stallings as a Tax Representative. At Easley, I represented commercial property owners to assure that their properties were being equitably assessed for county property tax purposes. My territory included Hillsborough, Pinellas, Orange, Osceola, Seminole, and counties including Marion and North into and throughout the Florida Panhandle. I also did work in Dade, Palm Beach and Broward Counties. My work gave me opportunities to appear before the Value Adjustment Boards and present cases as to how properties were being overassessed and why the tax values should be lowered. In the summer of 1989 I enrolled in law school at the Cumberland School of Law of Samford University in Birmingham, Alabama. I did this because I was of the belief that a legal education would enable me to better represent my clients and help people in general. In 1991 I finished law school and sat for and passed the Florida bar exam in February, 1992. Since becoming a lawyer I have represented property owners both informally with the Property Appraiser's office, before Value Adjustment Boards and also by filing lawsuits in Circuit Court. In early 1993 I became a member of the National, State and Local Boards of REALTORS. In 1998 I became a Florida Bar Board Certified Specialist in Real Estate Law. Continuously from 2005 through 2017 I have been appointed as Special Magistrate to the Value Adjustment Boards in Orange and/or Volusia Counties where I heard testimony and weighed evidence presented from Petitioners, experts and County Representatives prior to submitting a recommendation to the Value Adjustment Board for a final decision. The issues would be addressed usually involved either entitltement to exemptions (Homestead Tax Exemption, etc.), property classifications (Agricultural), or SOH/Portability.. My practice is currently primarily limited to represenation of Buyers, representation of Sellers, performing real estate closings and the issuance of title insurance.. I would like to hear from you. I have lived in Florida since I was 2 years old. First in Miami, then West Palm Beach, and now I make Orlando my home with my family.. Verbal battling was always natural to me, so it would seem ftting that being a lawyer was in my future. The trick, however, is to know when it's time to battle and when it's time to extend an olive branch. This is something that I belive comes naturally, but must be defined through experience. I now have about 15 years of experience as a lawyer and feel very comfortable in any setting against any other attorney in representing the best interests of my clients. After all, there is no reason to be afraid of another attorney, judge, prosecutor, or court itself. At least that's my position..
