REALLY need guidance please! Child custody, CPS involved.

child custody attorney Idaho Jul 31, 2026
Location: Idaho 1st question: So there’s a few kids involved, I have the kids most of the time. Partner and I have been living separately for four years now but technically still legally married. (Stupid I know) Their babysitter informed me that they had made a report to CPS due to actions (or lack there of) from the other parent. Constantly dropping them off in dirty clothes, diaper rashes, moldy lunchboxes and cups. They are a drug user as well, mainly weed/dabs, I think they drink as well. ——I’m going to be filing for divorce and I think I might apply for full custody. I do want full custody but is that something that’s even a possibility? If not, should I still apply for full custody and hope to get majority custody? I’m not sure how this works and I apologize. But my question is what are my chances here and is just applying for full custody the right move? CPS has made contact with me and I’ve been providing them with everything that I can. Additionally, the other parent NEVER attends doctor appointments, school events, etc. Additionally, separate question. When I submit for the divorce, can the other parent try and claim anything like my vehicle for instance that I purchased almost TWO years after they moved out?
