I switched sides! For me more than 20 years, I practiced employment law on the defense side, representing employers. I worked at prestigious law firms with amazing lawyers and learned from the best. Yet I felt like I was living the movie Groundhog Day. I was doing the same thing over and over again, raising the same defenses for the same employers that either couldn’t (or wouldn’t) fix the problems that caused their employees to take legal action.. California employment laws can be complicated, and they change regularly. But that does not excuse non-compliance.. Here’s what employers need do, but often fail to spend the time, energy, or money to achieve:. • Pay women and people of color the same as white men for performing substantially similar work.. • Pay workers their full wages in a timely manner and with accurate itemized paystubs.. • Stop classifying workers as exempt (not overtime-eligible) when they spend most of their time performing the same duties as the employees they supervise, and/or earn less than $1,240 per week ($64,480 per year).. • Hold supervisors and employees accountable for discrimination and harassment, and create a safe environment for employees.. • Conduct effective investigations when employees raise issues of discrimination, harassment, and unfair pay, and don’t retaliate against employees who complain.. • Advise employees of their rights to take leaves of absence, and don’t retaliate against employees who seek or take leave.. • Look for effective accommodations for disabled employees, rather than just placing them on indefinite unpaid leave or firing them.. I’m done defending employers. I know the law; I know what makes employers tick; and I know what buttons to push to drive results.
