Location: Montana Hi Reddit. I’m seeking advice regarding employment laws and HIPAA violation. I’ve worked for an AAAHC private practice for about a year and a half. My role is Treatment Coordinator but it’s within my scope to take payments from patients and send out statements which gives me access to patient charts and ledgers. I became aware that the practice was not paying patients back their overpayments once their insurance finalized when my coworker brought it my attention. She had been instructed to find all the patients whose accounts had been audited by our biller so that we could recoup that money. In doing so, she found over 500 patients that had credits on their account, ranging from $50-$10,000 with a note from our biller “credit is valid and due.” These are mostly from 2020-2026 but some date as far back as 2010. Some of these patients are Medicaid patients. Our financial policy that every patient signs states “If there is a credit on your account after insurance is settled, refunds can be initialed per patients request or the account will be audited within 6-12 months after the account settles. Checks will be issued after the account has been audited for accuracy in either case.” My coworker made a spreadsheet of all credits that were due and it totaled around $350,000. She brought it to the manager, our biller, and the doctor so that they could correct this mistake. They brushed it off and 11 months later, she gave…

Location: Montana, USA I’m having an ongoing disagreement with my manager about how the FMLA 50 employees within 75 miles rule applies to a multi-state employer, and I’m curious how other HR people would interpret this because at this point I feel like I’m going crazy. We’re a medium sized employer with around 500 employees total. Our corporate office has a little over 60 employees, so obviously we have 50+ employees within 75 miles of corporate. The other 400+ employees do not work out of corporate though. They work at different facilities across multiple states, and a lot of those locations have far fewer than 50 of our employees within 75 miles. My manager believes that because our corporate office has 50+ employees within 75 miles, basically everyone in the company can qualify for FMLA as long as they meet the 12 month and 1,250 hour requirements. Even if they physically work at one of our facilities in another state where we only have 20 or 30 employees anywhere near them. I have never understood FMLA that way. We obviously have more than 50 employees as a company, so yes, we are a covered employer. From everything I’ve ever learned about FMLA though, the employee still has their own eligibility requirements to meet. Location: South Carolina and Montana My little sister is trying to get ahold of her birth certificate so she can get an ID and her social. She is 18. Our mom was married to my dad when she had her in Montana and her biological father didn’t sign the birth certificate. So my biological dad has to sign a non paternal agreement (whatever it’s called) but he’s refusing to do it. Our mom is dead as well. They won’t give her the birth certificate. What can she do? Wondering about retaliation/ being fired (I do need money) if things go sideways So my buddies fiancé created a business (dirty soda trailer) and I am the first employee she hired, was there working all day on the grand opening (less than two months ago) with her. I’ve basically been working the afternoon/ evenings while she normally runs the morning shift. She has hired multiple teenage girls 14-19 for coverage/ assist her or myself. I even reduced my hours at my other job (morning shift) to help be available in the afternoon.
