We waited to be sure nothing fell through and felt confident after reading the buy out contract we signed for our lease renewal. Here is how the contract is set up. In one paragraph is says, " BUY-OUT PROCEDURES. Location: Arkansas. Backstory, my neighbors have an access easement on my property to get to their home. This easement is documented and in writing with paperwork from the county. My Neigbors have always considered this “their” Property, and have tried to argue it multiple times by verbally trying to kick us off us it. They sued the previous owner in 2006 and lost while trying to obtain it as a private drive. Documents do indicate they are to maintain it as needed. The current issues. We use the easement and as a piece of our property(since it is) , we frequently walk it, ride an ATV/ dirtbike on it to access other pieces of our property (recreational use). We recently received a letter from an attorneys office representing our Neigbors stating the easement is not to be used for a “recreational race track” and that we are damaging it and will seek us for compensation if we do not stop driving/riding on it. No damage has occurred while we use it as it is simply a gravel road and is not easily rutted / washed out. Is this something concerning or a lawsuit and winnable? Should we get an attorney on retainer and send a counter letter? These Neighbors are from hell, have placed debris, trash, trimmings on our property off the easement and tried to argue with multiple neighbors on the surrounding properties.

Location: Arkansas I interviewed recently for a job. I am 50 years old, and admittedly look at least that old, it's been a life full of both fun and hard times. During the interview, the hiring manager said he wasn't sure how to ask, then said something along the lnes of "Oh well, we don't have HR anyway". He then said the team was younger than him and sometimes he had trouble relating. I assured him that wouldn't be a problem. Cut to several days later and I am informed that the job went to someone else, that while they liked my resume they had someone who was a better "culture and team fit". I was also told I should bring more energy to the interview. This all seems to add up to me to a case of age discrimination. I have filed an enquiry with EEOC but I'm wondering if it is a waste of time.

Location: Arkansas. I currently co-own a home with my ex-wife, the home is currently for sale and recently went under contract and is due to close within the next two weeks. Our divorce decree states that my ex-wife is due a fixed dollar amount upon the sale of the home. Our divorce decree also states that my ex-wife will receive a $70,000 payout from my 401(k) account, a QDRO is currently in process with my 401(k) provider. The divorce decree does not state that the sale of the home is contingent on the 401(k) payout or vice versa. Here is my current problem, the title company I am using sent my ex-wife all of the paperwork for the deed release and sent her an affidavit stating that she has received the 401(k) money and that I am current on child support. She let the title company know that she has yet to receive the 401(k) money and that she would not sign the affidavit due to this. The title company contacted me and relayed this information and said that they could hold out the $70,000 from my portion of the proceeds from the sale of the house and give to my ex-wife. I questioned the title company and asked how that was legal? How is it legal to give my ex-wife an additional $70,000 cash from the sale of the home when she will still receive the $70,000 from my 401(k) account once the QDRO is processed. They stated that…

location: AR I volunteer at a VFW in Arkansas that runs a canteen. We’re also technically a private club. The bar side is smoking and 21+, as in no minors can enter ever. There is a banquet hall on the property that is rentable upon request and is non-smoking. We strictly adhere to all regulations and guidelines regarding signage, closing off areas, proper ventilation etc. According to the AR Clean Air Act of 2006, the smoking exemption states “All restaurants and bars licensed by the state that prohibit at all times all persons less than 21 years of age from entering the premises, if secondhand smoke does not infiltrate into areas where smoking is prohibited under this rule.” We received an anonymous complaint (we believe through a disgruntled former member) filed through the health department claiming we allow minors in the bar. We don’t. There is also no proof provided in the complaint. The health dept came this week and told us we can no longer operate as a split facility- either the whole facility is 21+ or we’re non smoking throughout. I’m struggling to understand why this is even allowed. Its a first “offense” with no proof and was absolutely untrue. Is there anything I can do to repeal? How does this work? TIA.
