Kelly frequently represents benefit plan sponsors in connection with benefit plan operation, qualification and prohibited transaction issues, including representation before the IRS and U.S. Department of Labor in compliance audits and various plan correction issues. Kelly assists employers in implementing legally compliant wellness plans to promote employee health and the reduction of preventable participant health costs. Kelly also provides employers with advice and strategies for dealing with the ACA’s Pay-or-Play Rules, reporting requirements, as well as technical assistance in assessing ACA design opportunities, options, and the impact of ACA rules on other employer benefit programs..
